The present article provided an in-depth analysis of the legal and regulatory framework governing the issuance of building permits in Greece, as well as focusing on recent legislative<\/p>

developments and their impact on the construction sector.<\/p>

Over the last decade, there have been continuous changes in the provisions on the way building permits are issued and in those of the building regulation. In the same period, there have been significant changes in the legal framework on issues related, for example, to the electronic procedure for issuing building permits or the institution of building inspectors, but also many smaller interventions in an effort to reduce bureaucracy, strengthen enforcement and reduce the time required for the issuance of the permit.<\/p>

The article provided for key developments and impacts, namely it started with a brief historical review <\/strong>of the Greek State and continued with a list of the most important pieces of<\/strong><\/p>

legislation <\/strong>in order to understand the needs for legislation, the general philosophy of the legislative framework for the way of issuing permits <\/strong>and the new needs arising <\/strong>from the evolution of law and modern institutional tools (cadastre, forest maps, electronic databases,<\/p>

digitisation of plans and diagrams, etc.), as follows:<\/p>

Transfer of Authority (Law 4030\/2011): <\/strong>This law transferred the responsibility of issuing building permits to the Building Services of the Municipalities. It also established independent<\/p>

Building Inspectors, separate from Building Services, to oversee the correct execution of permits. The law introduced the option for electronic submission of all necessary documents and studies, aiming to streamline the process.<\/p>

Streamlining Procedures (Law 4495\/2017): <\/strong>This law focused on minimizing the time required<\/p>

for issuing building permits, simplifying procedures, combating corruption, and attracting investors. It mandated an exclusively electronic process for the submission, review, and granting of building permits and approvals. The law also introduced the concept of pre-approval for building permits, either as an optional or mandatory step depending on specific cases.<\/p>

Creation of Regional Collective Bodies: <\/strong>In order to ease the workload of existing services and<\/p>

to provide a platform for examining appeals, it was mentioned that regional collective bodies<\/p>

with distinct responsibilities were established. This development aimed at efficient service provision to citizens and also addressing the backlog of cases in a timely manner.<\/p>

Challenges and Unmet Goals (Law 4759\/2020): <\/strong>Despite the ambitious goals set by Law 4495\/2017 and partially by Law 4030\/2011, especially regarding the duration of the licensing<\/p>

process, these objectives were not fully achieved. Ten years after Law 4030\/2011, there was<\/p>

still a search for more effective solutions.<\/p>

The legislative changes in Greece’s building permit process over the last decade represented<\/p>

significant efforts to modernise and streamline the system<\/strong>. While laws like 4030\/2011 and 4495\/2017 introduced crucial reforms such as electronic submission and independent building inspectors, challenges remained in achieving the desired efficiency. The introduction of Law 4759\/2020 acknowledged these challenges, indicating a continuous effort to optimize the building permit system in Greece.
